Workers Comp

The firm is experienced in litigating workers' compensation matters from the filing of the initial claim petition, ensuring that the notice of compensation payable includes all work related injuries, and obtaining, maintaining and settling a worker's wage loss or medical benefits.

  • Claim Petition filed for 59 year old Claimant, who suffered psychological injury after being exposed to snakes in her office building. Claim settled prior to decision.

  • Factory worker developed carpal tunnel syndrome. Three years later notice of compensation payable expanded to include aggravation of pre-existing post traumatic stress syndrome. Claimant continues to receive ongoing benefits.

  • Warehouse worker injured his knee during the course of his employment, eventually undergoing three surgeries and requiring continual use of crutches. Petition to Review Compensation Benefits was filed to have cardiovascular disease included in the injury description. Settlement reached prior to decision.

  • Minor injured his right hand while operating a saw. Petition filed to increase compensation rate based upon violation of Child Labor Law when Employer employed minor without work permit or employment certificate.

  • Welder sustained multiple neck and back injuries. The Employer filed a petition to stop the claimant's benefits, during which time the claimant's treating physician, removed the claimant from the workplace, causing the employer to file a modification/suspension petition based upon available work. In addition, the issue of reasonableness of treatment was litigated. The matter was settled by the payment of a lump sum and the use of a medical trust.
